TO THE FULLEST EXTENT PERMITTED BY LAW, OUÇAIRE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO OUÇAIRE IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless Ouçaire, its officers, directors, employees, and affiliates from any claims, liabilities, damages, losses, and expenses arising out of your violation of these Terms or misuse of the Services.

19. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles.

You agree that any legal action shall be brought exclusively in the state or federal courts located in Texas, and you consent to their jurisdiction.

20. MISCELLANEOUS

• Entire Agreement: These Terms constitute the entire agreement between you and Ouçaire.
• Severability: If any provision is held unenforceable, the remaining provisions remain in full force.
• No Waiver: Our failure to enforce any right does not waive that right.
• Assignment: You may not assign these Terms without our prior written consent.
